Attack on CJI Gavai: Supreme Court lawyer seeks contempt proceedings against Rakesh Kishore
A Supreme Court lawyer has sought contempt proceedings against lawyer Rakesh Kishore, who attempted to attack Chief Justice BR Gavai by throwing a shoe when he was hearing cases in the court.

As Live Law reports, lawyer Subhash Chandran KR wrote a letter to Attorney General R Venkataramani seeking consent under Section 15 of the Contempt of Court Act, 1971.

He said Kishor’s actions undermine the dignity of the Supreme Court and amount to interference in the administration of justice.

“The most outrageous act of the contemnor lowers the majesty and authority of the Honorable Supreme Court and defeats the Constitution of India,” the letter said.

Chandran also said that Kishore showed no remorse for his actions and made derogatory comments in the media. He said the teen tried to justify his actions and that such behavior undermines people’s faith in the judicial system.

He also described these actions as a deliberate attempt to discredit the court.

Attempt to attack CJI Gavai

On 7 October, Kishore tried to take off and throw his shoe at the Chief Justice of India after he reached the stage.

However, his efforts were immediately stopped by the security personnel in the court room and he was escorted out.

He shouted, “Sanatan Dharm ka apmaan nahi sahenge (Will not tolerate insult to the Sanatan Dharma),” while moving out of the court.

He alleged that CJI Gavai has insulted Sanatan Dharma with his comments and hurt the religious sentiments of the Hindu community, which cannot be tolerated.

Later, the Bar Council of India immediately suspended Kishore.

Kishore also said that he was not afraid and did not regret his actions.

“I was hurt… I was not drunk, it was my reaction to his action… I am not afraid. I do not regret what happened,” he told news agency ANI in an interview.

CJI’s comment is going viral on social media

The incident was linked to CJI Gavai’s previous comments in the case related to the restoration of the idol of Lord Vishnu in the Khajuraho group of temples.

According to Bar and Bench, CJI Gavai, while dismissing the plea, had reportedly remarked, “Go and ask the deity itself to do something. You say you are a staunch devotee of Lord Vishnu. So go now and pray. This is an archaeological site and the ASI needs to give permission etc.”

His remarks were widely shared on social media and sparked controversy, with people alleging that the statement had hurt religious sentiments.

The CJI later clarified that he respected all religions and did not intend to hurt the sentiments of any community. CJI Gavai said, “I respect all religions.”
