Delhi High Court directs Election Commission to allot common election symbol to Akhil Bharatiya Jana Sangh for Bihar elections

The Delhi High Court on Thursday, October 9, ordered the Election Commission of India (ECI) to allot a common election symbol to the All India Jan Sangh for the upcoming Bihar Legislative Assembly elections, Bar and Bench reported.

This order was passed by Justice Mini Pushkarna.

The court directed the party to submit an application to the ECI as per the Election Symbols (Reservation and Allotment) Order.

“Subject to compliance of the said direction by the petitioner, it is directed that the petitioner shall be forthwith allotted a common symbol to contest the Bihar State Assembly elections,” the bench said.

Akhil Bharatiya Jana Sangh, registered in 1989 and claiming its origins in the Bharatiya Jana Sangh, had challenged the Election Commission’s September 1 communication rejecting its request for a symbol. The party argued that the denial violated its constitutional and statutory rights, citing incorrect reasoning and absence of internal disputes, as alleged by the ECI.

This is the second time the party has approached the High Court following its previous petition, following which the Court directed the ECI to expeditiously consider its August 25 representation. The petitioner was represented by advocates Pranay Ranjan and Mrigank Prabhakar.
